Wirral Evolutions Ltd is a Local Authority Trading Company which means that we are a registered company (company no: 09589553) which reports to the Local Authority (Wirral Borough Council) as our shareholder.
Our Board ensures that corporate governance is adhered to and that there are practices and process in place which balance the needs of the people we support, the business and our shareholder.

Principles of This Notice
Wirral Evolutions Ltd is committed to respecting your privacy.
This notice explains how we use personal information we collect and how we comply with Data Protection law and what your rights are.
This notice applies to:
- people we support and their representatives
- our workforce[1]
- people who have requested to receive updates regarding the company
- individual clients or an employee of a corporate client who work in partnership with Wirral Evolutions
All references to ‘we’, ‘our’ or ‘us’ in this privacy notice are to Wirral Evolutions Ltd.

What Information We Collect
We will only hold information that is necessary for a specific purpose, which will be provided at the time the information is collected.
Special Categories of Personal Information
GDPR outlines ‘special categories’ of more sensitive personal information as:
- Race and ethnic origin
- Religious or philosophical beliefs
- Political opinions
- Trade union memberships
- Biometric data used to identify an individual
- Genetic data
- Health data
- Data related to sexual preferences, sex life, and/or sexual orientation
We do not collect all of the above categories, but in relation to special categories we do process, this is done on the basis that:
- It is necessary on a lawful basis or for reasons of substantial public interest
- It is necessary as part of legal claims
- It is necessary as part of employment, social security and social protection law
- It is based on your explicit consent
We can also collect criminal records history on the basis of legal obligations or based on your explicit consent.
How We Collect Information & Why
You have the right to be informed about how we collect and use your personal information. When we collect information from you, we will provide you with privacy information.
There are two main ways we collect information from you:
Directly
Most of the personal information we process is provided to us directly from you.
When we collect information from you, we will always advise you of the purpose for collecting this information.
We will not collect more information than we need from you, and we will not collect information when there is not a specified reason for doing so.
Indirectly
From time to time we may also receive personal information indirectly. Indirect information comes from either a third-party organisation or information which is publicly available. We will only do this if it is completely necessary under GDPR.
How We Use Information
We use the information that you have given us in order to maximise services for people we support and to communicate with our stakeholders.
We may share this information with our partners (e.g. social services, safeguarding) where it is in the best interests of the people we support. We will never share information with third parties for marketing purposes. We will never sell your information to third parties.
When we collect information from you, we will advise the purpose of collecting the information and how we intend to use it.
How We Store Your Information
Your information is securely stored at our locations and/or electronically on our staff network. Any information stored is only accessible by the relevant members of our workforce.
Any information that is no longer needed is disposed of responsibly. We will only store information if it is required or relevant.
Wirral Evolutions adopts Wirral Councils Retention Policy and Procedures. This includes the following:
- Staff records - Employee Personal files from the date of leaving, information is retained for 6 years
- Requests for leave – Date of request, information is retained for 12months if filed separately to their personnel file.
- Signing-in sheets – Retained for 6 years from the date of entry.
- Community trip forms – Retained for 6 years from the date of the form.
- Accident and incident forms – Retained for 6 years from the date of the accident or incident.
- People we support case files – Date of death / date ceased using service and retained for 8 years of this date.
- Records of medication administered (MAR) – Retained for 8 years from the date of administration.
Your Data Protection Rights
Under data protection law, you have rights including:
- Your right of access - You have the right to ask us for copies of your personal information.
- Your right to rectification - You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
- Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.
- Your right to restriction of processing - You have the right to ask us to restrict the processing of your information in certain circumstances.
- Your right to object to processing - You have the the right to object to the processing of your personal data in certain circumstances.
- Your right to data portability - You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

Changes to Our Privacy Notice
We review and update this privacy notice from time to time. When changes occur, we will update the version number and date. When significant changes are made (such as changes to the law) we will notify you and seek your consent to apply changes that will affect you and your information.
